The Swedish Police Authority has awarded a contract for medical services in an incorrect way
The Swedish Police Authority performed an illegal direct award of contract when procuring medical services. The estimated total value of the contract is approximately SEK 14 million. The Swedish Competition Authority is therefore petitioning for the imposition of a procurement fine of SEK 1.2 million.
The Swedish Police Authority’s framework agreement for medical services expired in May 2018. On the expiry of the framework agreement, the Swedish Police Authority entered into a verbal agreement with the supplier to continue calling off medical services. This agreement was never documented. Nor is there documentation of ongoing purchases.
The Swedish Police Authority’s direct award of contract for medical services has continued for a number of years. The Swedish Competition Authority’s review relates to the agreement that the Swedish Police Authority entered into on behalf of Police Region Stockholm in November 2022. A summary of invoices related to the orders placed during the period shows that the total value of the contract is approximately SEK 14 million. In the opinion of the Swedish Competition Authority, this amounts to an illegal direct award of contract.
“A contracting authority must organise its purchasing work in a manner that complies with the rules on public procurement. Inadequate routines present a risk that purchases will be more expensive. It will also be more difficult to follow up and control the services delivered,” explains Rikard Jermsten, Director General of the Swedish Competition Authority.
The Swedish Competition Authority is therefore petitioning the Administrative Court in Stockholm to impose a procurement fine of SEK 1.2 million for an illegal direct award of contract. The size of the fine reflects the fact that the Swedish Police Authority has made illegal direct awards of contract on previous occasions.
